Welcome to GETXH Automation. These Terms and Conditions ("Terms") govern your access to and use of the GETXH Automation website, products, services, software, automation systems, AI assistants, communication tools, integrations, and related offerings (collectively, the "Services").
By accessing our website, booking a consultation, submitting information, purchasing services, engaging with our team, or otherwise using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you should discontinue use of our website and Services immediately.
1. About GETXH Automation
GETXH Automation is a business automation agency that designs, develops, configures, deploys, manages, and maintains automation systems intended to assist businesses in lead capture, lead qualification, appointment scheduling, customer communication, workflow automation, AI-powered assistance, reporting, and related business processes. Services may include, but are not limited to:
- WhatsApp AI Assistants
- Lead Qualification Systems
- Appointment Booking Automation
- AI Receptionist Solutions
- Voice AI Systems
- CRM Integrations
- Workflow Automations
- Business Process Automation
- Custom Automation Projects
- Ongoing Monitoring and Maintenance
The specific scope of services provided to a client shall be determined by written agreement, proposal, invoice, service package, or other mutually agreed documentation.
2. Eligibility
Our Services are intended for businesses, professionals, entrepreneurs, organizations, and individuals acting on behalf of legitimate business activities. By using our Services, you represent and warrant that:
- You are at least 18 years old.
- You possess the legal authority to enter into binding agreements.
- You are authorized to act on behalf of any business or organization you represent.
- You will provide accurate information during communications with GETXH Automation.
- Your use of the Services complies with all applicable laws and regulations.
GETXH Automation reserves the right to refuse service to any individual, business, or organization at its sole discretion.
3. Service Nature
GETXH Automation provides technology implementation, automation consulting, deployment services, and related support. While our Services are designed to improve operational efficiency, lead response times, lead qualification processes, customer communication, and appointment scheduling workflows, we do not guarantee specific business outcomes. Business performance can be influenced by numerous factors outside our control, including:
- Market conditions
- Advertising quality
- Lead quality
- Sales performance
- Competition
- Customer demand
- Internal business processes
- Industry conditions
Accordingly, GETXH Automation does not guarantee revenue increases, profit increases, sales volume, lead volume, appointment volume, conversion rates, or business growth. Any examples, projections, demonstrations, illustrations, simulations, estimates, testimonials, case studies, or performance metrics presented by GETXH Automation are provided for informational purposes only and should not be interpreted as guarantees of future performance.
4. Client Responsibilities
Clients remain responsible for the operation of their business and for all decisions made based on information generated by automation systems. Clients agree to:
- Provide accurate information.
- Cooperate during implementation.
- Maintain required third-party accounts.
- Review automation outputs periodically.
- Verify important customer communications.
- Maintain compliance with applicable laws.
Clients acknowledge that automation systems may require configuration, updates, supervision, testing, and optimization over time. Failure to provide necessary cooperation, information, approvals, or access may delay implementation timelines and affect project outcomes.
5. AI Systems and Automation Limitations
Certain GETXH Automation services may utilize artificial intelligence technologies, machine learning systems, language models, automation engines, third-party APIs, and related technologies. While significant efforts are made to improve reliability, AI-generated responses may occasionally contain inaccuracies, incomplete information, misunderstandings, or unintended outputs. Clients acknowledge and agree that:
- AI systems are not infallible.
- Automated responses should not be considered professional legal, financial, medical, or regulatory advice.
- AI-generated outputs may require human review.
- Performance may vary depending on training data, configuration, prompts, integrations, and business context.
GETXH Automation shall not be liable for decisions made solely on the basis of AI-generated outputs. Clients are encouraged to implement appropriate review processes for business-critical communications and decisions.
6. Third-Party Services
Our Services may rely on third-party platforms, technologies, software providers, hosting services, communication providers, payment processors, scheduling systems, analytics providers, cloud infrastructure providers, and integration partners. Examples may include the WhatsApp Business Platform, Google services, OpenAI services, Meta platforms, CRM platforms, calendar providers, and cloud hosting providers.
GETXH Automation does not control these third-party providers and cannot guarantee their availability, functionality, uptime, pricing, security policies, or future service offerings. Service interruptions caused by third-party providers shall not constitute a breach of these Terms by GETXH Automation.
7. Fees and Payments
All fees, setup charges, subscription fees, maintenance charges, consulting fees, and project costs are outlined in applicable proposals, invoices, quotations, packages, or service agreements. Unless otherwise agreed:
- Fees are payable in advance.
- Setup fees are non-refundable once implementation begins.
- Monthly service fees remain due according to the agreed billing schedule.
- Delayed payments may result in suspension of services.
Failure to pay fees may result in service interruption, suspension of access, delayed support, or termination of services. GETXH Automation reserves the right to modify pricing for future service periods with reasonable notice.
8. Refund Policy
GETXH Automation invests significant time, technical resources, configuration work, consultation efforts, implementation planning, testing procedures, and deployment activities before and during service delivery. Accordingly, unless otherwise agreed in writing, setup fees, implementation fees, onboarding fees, consultation fees, and custom development fees are generally non-refundable once work has commenced.
Refund requests may be reviewed on a case-by-case basis and shall be evaluated based on factors including project stage, work completed, resources allocated, and contractual obligations. Clients acknowledge that dissatisfaction resulting from business performance, lead quality, advertising performance, market conditions, sales results, or customer behavior shall not automatically qualify for a refund. Where recurring subscription services are provided, cancellation of future billing may be requested in accordance with applicable notice requirements.
9. Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights associated with GETXH Automation's systems, methodologies, frameworks, templates, processes, workflows, documentation, automation architectures, implementation techniques, and proprietary materials remain the exclusive property of GETXH Automation. Clients receive a limited, non-exclusive, non-transferable right to use deliverables provided under the applicable service agreement. Nothing contained within these Terms shall be interpreted as transferring ownership of GETXH Automation intellectual property to any client. Clients shall not:
- Copy proprietary systems.
- Reverse engineer solutions.
- Resell proprietary frameworks.
- Reproduce internal methodologies.
- Create derivative works based upon confidential implementation processes.
Any unauthorized use may result in immediate termination of services and legal action where appropriate.
10. Client Content
Clients retain ownership of content, materials, customer information, branding assets, data, documents, and information supplied to GETXH Automation. By providing such content, clients grant GETXH Automation the limited rights necessary to deliver requested services, configure systems, process workflows, provide technical support, and maintain service functionality. Clients represent and warrant that they possess all necessary rights, permissions, licenses, and authorizations required to provide such content. GETXH Automation shall not be responsible for verifying ownership of client-provided materials.
11. Confidentiality
Both parties acknowledge that confidential information may be exchanged during the course of the business relationship. Confidential information may include business strategies, customer information, pricing information, marketing plans, sales processes, technical documentation, internal procedures, and proprietary business information. Each party agrees to use reasonable efforts to protect confidential information and to refrain from unauthorized disclosure except where required by law. Confidentiality obligations shall survive the termination of the business relationship.
12. Data Protection
GETXH Automation recognizes the importance of responsible data handling practices. Reasonable technical, organizational, and administrative safeguards may be implemented to help protect information from unauthorized access, disclosure, misuse, alteration, or destruction. However, clients acknowledge that no system is completely immune from security risks, internet transmissions cannot be guaranteed as fully secure, and third-party service providers maintain independent security practices. Clients remain responsible for complying with all laws applicable to their own customer data, marketing activities, communication practices, and business operations.
13. Service Availability
GETXH Automation strives to provide reliable and professional services. However, uninterrupted availability cannot be guaranteed. Services may be affected by maintenance activities, infrastructure upgrades, third-party outages, software updates, internet disruptions, force majeure events, and platform policy changes. Temporary interruptions shall not automatically constitute service failure. GETXH Automation reserves the right to perform maintenance and operational improvements as reasonably necessary.
14. Support Services
Support availability may vary depending on the selected service package, maintenance plan, subscription level, and project agreement. Support services may include technical assistance, bug investigation, configuration adjustments, performance reviews, and general guidance. Support does not include unlimited custom development unless explicitly stated within a written agreement. Response times are targets only and are not guaranteed unless separately agreed in writing.
15. No Professional Advice
Information provided by GETXH Automation, including recommendations, reports, insights, analyses, AI-generated outputs, consultations, and communications, is provided for informational and operational purposes only. Nothing provided through the Services shall constitute legal advice, financial advice, tax advice, regulatory advice, or investment advice. Clients are encouraged to seek qualified professional advisors where appropriate.
16. Limitation of Liability
To the maximum extent permitted by applicable law, GETXH Automation, its owners, employees, contractors, affiliates, agents, suppliers, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to service interruptions, business losses, lost revenue, lost profits, lost opportunities, customer disputes, data loss, third-party platform actions, AI-generated errors, delayed responses, or marketing performance.
The total liability of GETXH Automation for any claim arising from the Services shall not exceed the total amount paid by the client to GETXH Automation during the three months immediately preceding the event giving rise to the claim.
17. Indemnification
The Client agrees to defend, indemnify, and hold harmless GETXH Automation, its owners, employees, contractors, consultants, affiliates, partners, licensors, service providers, and representatives from and against any and all claims, demands, liabilities, losses, damages, judgments, penalties, costs, expenses, and legal fees arising from or related to:
- The Client's use of the Services.
- Violation of these Terms.
- Violation of applicable laws or regulations.
- Content supplied by the Client.
- Marketing activities conducted by the Client.
- Communications sent by the Client.
- Customer disputes involving the Client.
- Unauthorized use of third-party content.
- Violations of privacy, advertising, consumer protection, or data protection laws.
This obligation shall survive termination of the business relationship.
18. Termination
Either party may terminate a service relationship in accordance with any applicable written agreement, subscription plan, proposal, invoice terms, or service contract. GETXH Automation reserves the right to suspend or terminate access to Services immediately if required payments remain unpaid, the Client engages in unlawful activities, the Client abuses support resources, the Client provides misleading information, or continued service would expose GETXH Automation to legal, operational, reputational, or financial risk.
Upon termination, access to systems may be revoked, ongoing support obligations may cease, outstanding invoices become immediately due, and certain client data may be retained where required by law or legitimate business purposes. Termination shall not affect rights or obligations accrued before termination.
19. Force Majeure
GETXH Automation shall not be liable for delays, interruptions, failures, or inability to perform obligations resulting from circumstances beyond its reasonable control. Such circumstances may include, without limitation, natural disasters, floods, fires, earthquakes, pandemics, government actions, regulatory changes, internet outages, cybersecurity incidents, labor disputes, utility failures, cloud provider disruptions, third-party platform restrictions, telecommunications failures, and acts of war or terrorism. Performance obligations affected by such events shall be suspended for the duration of the relevant event.
20. Third-Party Platform Policies
Many GETXH Automation services depend on third-party platforms including messaging platforms, AI providers, hosting providers, communication tools, scheduling systems, CRM systems, analytics providers, and other external technologies. Clients acknowledge that third-party providers may modify features, change pricing, discontinue services, suspend accounts, or impose usage restrictions. GETXH Automation shall not be responsible for actions taken by third-party providers or for losses resulting from changes made by such providers. Clients remain responsible for complying with all applicable third-party terms, policies, and platform requirements.
21. Representations and Warranties Disclaimer
Except as expressly stated in writing, all Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, GETXH Automation disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and performance. GETXH Automation does not warrant that Services will be uninterrupted, error-free, meet all business expectations, generate specific business results, or that third-party platforms will remain available.
22. Modifications to Services
GETXH Automation reserves the right to modify, improve, replace, suspend, or discontinue portions of its Services at any time where reasonably necessary. Such modifications may include feature updates, security improvements, infrastructure changes, technology upgrades, service refinements, and integration adjustments. Reasonable efforts may be made to provide advance notice where practical.
23. Changes to These Terms
GETXH Automation may revise these Terms from time to time to reflect service changes, business developments, legal requirements, regulatory requirements, and industry best practices. Updated Terms shall become effective upon publication on the website unless otherwise stated. Continued use of the Services after updated Terms are published constitutes acceptance of the revised Terms.
24. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or relating to these Terms, the Services, or the relationship between the parties shall be subject to the exclusive jurisdiction of the competent courts located in Rajasthan, India. Both parties consent to such jurisdiction and venue.
25. Dispute Resolution
Before initiating formal legal proceedings, the parties agree to attempt to resolve disputes through good-faith discussions. Either party may provide written notice describing the dispute and the requested resolution. The parties shall make reasonable efforts to resolve disputes amicably before pursuing litigation where legally permitted. Nothing in this section shall prevent either party from seeking urgent legal relief where necessary to protect rights, confidential information, intellectual property, or business interests.
26. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be interpreted to the maximum extent permissible to reflect its original intent.
27. No Waiver
Failure by GETXH Automation to enforce any provision of these Terms shall not constitute a waiver of any right or provision. Any waiver must be expressly made in writing.
28. Entire Agreement
These Terms, together with any applicable Privacy Policy, service agreements, proposals, invoices, statements of work, quotations, and written communications expressly incorporated herein, constitute the entire agreement between the parties regarding the Services. They supersede all prior discussions, understandings, representations, and agreements relating to the same subject matter.
